The European Union now has two major horizontal regulations that directly shape how organisations handle personal data in technology systems. The General Data Protection Regulation (GDPR), in force since May 2018, governs the processing of personal data. The AI Act (Regulation (EU) 2024/1689), which entered into force on 1 August 2024, regulates AI systems based on the risk they pose to fundamental rights and safety. Its obligations phase in through February 2025 (prohibited practices), August 2025 (general-purpose AI), and August 2026 (high-risk systems).

The AI Act imposes transparency obligations on deployers of high-risk systems (Article 13) and disclosure requirements for limited-risk systems like chatbots (Article 50).

Automated decision-making

Article 22 GDPR gives individuals the right not to be subject to solely automated decisions producing legal or similarly significant effects, unless specific conditions are met. The AI Act reinforces this by requiring human oversight for high-risk systems (Article 14), mandating that assigned persons can effectively intervene.

The overlap creates a dual safeguard: GDPR Article 22 gives individuals the right to contest automated decisions, while the AI Act requires the system to allow meaningful human intervention. The EDPB has confirmed that Article 22 applies to profiling producing legal effects – capturing most high-risk AI use cases such as credit scoring, insurance pricing, and public benefits administration.

Impact assessments

GDPR Article 35 requires a DPIA when processing is likely to result in high risk. The AI Act requires a fundamental rights impact assessment for deployers of high-risk AI systems under Article 27. The EDPB noted in its joint opinion with the EDPS on the AI Act that the two assessments should be coordinated to avoid duplication. Both require organisations to describe the system and its purposes, assess proportionality, identify risks, and document mitigating measures. Where Do AI Act and GDPR Diverge?

Enforcement architecture. The GDPR is enforced by national data protection authorities coordinated through the European Data Protection Board. Fines reach up to EUR 20 million or 4% of global annual turnover. The AI Act is enforced by national market surveillance authorities, with the European AI Office coordinating. Fines are steeper: up to EUR 35 million or 7% of global turnover for prohibited AI practices, and EUR 15 million or 3% for high-risk violations. A single AI system could face parallel enforcement from both authorities.

Regulated parties. The GDPR regulates data controllers and processors. The AI Act regulates providers (developers), deployers (professional users), importers, and distributors. These roles do not map neatly: a company deploying a third-party AI system is a “deployer” under the AI Act and simultaneously a “data controller” under the GDPR, with independent obligations under each.

Approach to data. The GDPR restricts personal data processing through data minimisation, purpose limitation, and storage limitation. The AI Act may require more data: Article 10 mandates that training and testing data sets for high-risk systems be sufficiently representative and free of errors. Recital 67 acknowledges that processing sensitive personal data may be necessary to detect bias – a direct tension with GDPR Article 9’s restrictions on special category data.
